Zoning × Land Control × KBLI × OSS Permits (2025–2026)
In these days there are much talks about compliance in Bali and various new regulations has been issued to streamline but also to enforce correct zoning, KBLI’s and subsequent permits. Its essential that these guidelines is followed for any new investment.
And if its an existing investment then it must come into compliance no later than March 31. 2026.
1) Why this white paper exists (and why “licensing later” is now a liability)
The compliance landscape has tightened across the whole chain—from zoning suitability, to environmental approval, to tourism standards, to supervision and sanctions.
This paper is built on four key regulatory pillars:
1. Peraturan Pemerintah (PP) 28/2025 — the current “umbrella” for Risk-Based Business Licensing (PBBR) and the integrated OSS approach, including the role of persyaratan dasar (basic requirements).
2. Peraturan Menteri Investasi/BKPM no 5/2025 — the operational rulebook for running licensing and investment facilities through OSS (procedures, governance, and implementation mechanics).
3. Peraturan Menteri Parwisata no 6/2025 — tourism sector business activity standards, how supervision is conducted, and administrative sanctions for tourism licensing under PBBR.
4. Undang-Undang no 18/2025 — the Third Amendment to the Tourism Law (a higher-level policy reset that strengthens governance direction, instruments, and implementation framework).
Practical takeaway:
In Bali accommodation, the “old habit” of picking a property first and arguing legality later is increasingly what creates enforcement risk. The only sustainable pathway is:
(1) zoning proof → (2) correct KBLI → (3) OSS basic requirements → (4) tourism standards readiness → (5) operational discipline.
